Terms of Service

By accessing or using SurgBoardsQ&A (surgicalboardsqa.com), you agree to be bound by these Terms of Service. If you do not agree, you may not use the platform.

These terms constitute a binding agreement between you and Dr. Pablo Lozano Lominchar, the operator of BoardsQA, acting in personal capacity as educator. This platform does not represent Hospital General Universitario Gregorio Marañón or Universidad Complutense de Madrid.

To access quiz sessions and track progress, you must create an account using a valid email address. You agree to:

• Provide accurate and complete information during registration
• Keep your account credentials confidential
• Notify us immediately of any unauthorized access at lozanon57@gmail.com
• Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these terms.

BoardsQA offers two access tiers:

• Free tier: 50 questions total. No payment required. Access to all boards until the free trial limit is reached.
• Pro tier: Unlimited questions per day, full progress analytics, and export features. Billed monthly or annually as displayed at checkout.

Payments are processed by Stripe (PCI-DSS compliant). Your subscription is charged once, for the period you selected, and does not renew automatically. It simply ends on its expiry date unless you choose to subscribe again. You will never be charged a second time without starting a new subscription yourself.

3.1 Right of withdrawal (EU consumers)

If you are a consumer resident in the European Union you have the right to withdraw from this contract within 14 calendar days from the day it is concluded, without giving any reason and without penalty (Directive 2011/83/EU; Spanish Royal Legislative Decree 1/2007, arts. 102 et seq.).

To exercise it, tell us your decision by an unequivocal statement — email is sufficient — to lozanon57@gmail.com, or use the model withdrawal form published in Annex A of Royal Legislative Decree 1/2007. We will reimburse all payments received from you without undue delay and no later than 14 days from the day we are informed, using the same means of payment you used.

Loss of the right through immediate access. This subscription supplies digital content that is made available to you immediately. Before payment, you are asked to expressly request that immediate access and to acknowledge that, once access has been provided, you lose your right of withdrawal (Directive 2011/83/EU art. 16(m); Royal Legislative Decree 1/2007 art. 103.m). If you do not give that consent, the subscription cannot be started. We record the date and time of that consent alongside your payment.

Goodwill refunds. Independently of the above, if the platform is not what you expected, write to us within 14 days of your first subscription and we will refund you. This is a commercial commitment on our part and does not limit any statutory right you may have.

You agree to use BoardsQA exclusively for lawful educational purposes. You may not:

• Scrape, copy, or systematically extract question content by automated means
• Share account credentials or allow third parties to access your account
• Reproduce or redistribute question content without written permission
• Attempt to reverse-engineer or circumvent platform security measures
• Use the platform for clinical decision-making or patient care purposes
• Impersonate another person or entity in communications through the platform

Violation of acceptable use terms may result in immediate account suspension without refund.

All question content, explanations, guideline summaries, and platform design are the intellectual property of Dr. Pablo Lozano Lominchar. All rights reserved. In addition, the question bank constitutes a database in which the maker has made a substantial investment in obtaining, verifying and presenting its contents, and is protected by the sui generis database right (Directive 96/9/EC art. 7; Spanish Consolidated Text of the Intellectual Property Act, arts. 133 et seq.). Extraction or re-utilisation of all or a substantial part of the database, and repeated extraction of insubstantial parts, are prohibited.

You are granted a personal, non-exclusive, non-transferable license to access platform content for your individual educational use only. This license does not include the right to copy, reproduce, distribute, publish, or create derivative works from any platform content.

To the fullest extent permitted by applicable law, BoardsQA and Dr. Pablo Lozano Lominchar shall not be liable for:

• Any indirect, incidental, or consequential damages arising from platform use
• Clinical outcomes resulting from reliance on platform content
• Interruptions in platform availability
• Inaccuracies in question content, which may not reflect current guidelines

Total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

These Terms of Service are governed by Spanish law and applicable European Union law. Any dispute arising from these terms shall be submitted to the courts of Madrid, Spain, unless mandatory consumer protection rules in your jurisdiction provide otherwise.

We may update these Terms of Service. Changes will be notified to registered users by email at least 14 days before taking effect. Continued use of the platform after the effective date constitutes acceptance of the updated terms.
