The question bank additionally constitutes a protected database: its maker has made a substantial investment in obtaining, verifying and presenting its contents, and it is protected by the sui generis right of articles 133 et seq. of that Act and article 7 of Directive 96/9/EC. Extraction or re-utilisation of all or a substantial part of the database, and repeated extraction of insubstantial parts, are prohibited and will be pursued.
